Press statement by YAB Tuan Lim Guan Eng, Chief Minister of Penang at KOMTAR on the 15th of December, 2014.

The State government has facilitated the rehabilitation of Phase 2A of the abandoned Majestic Heights project involving 370 property owners, by successfully procuring PLB Sdn Bhd to agree to rehabilitate the same. This project was abandoned since 1998.

After the announcement of the said rescue project by PLB Sdn Bhd in April this year, the white knight company has now finalised the construction agreement which is to be executed by the purchasers and their subsidiary, PLB KH Bina Sdn Bhd.

Amongst others the pertinent terms in the agreement is that the purchaser will pay a sum of RM10,000.00 to a firm of solicitors which will hold the same as stakeholders, whereby RM5,000.00 will be disbursed to the company upon commencement of works and the balance RM5,000.00 will be disbursed upon completion of the said project. It should be noted the sum of RM10,000.00 was agreed upon after successful negotiation by the State government and the company which had initially proposed RM45,000.00 be paid by each purchaser for the rehabilitation of the said abandoned Phase 2A of Majestic Heights. The total cost involved to revive the said abandoned phase 2A of Majestic Heights stands at RM17 million.

Further, after successful negotiation between the State government and the company, the company has agreed to extend the defect liability period from 3 months to 12 months.

Under the said construction agreement the company has agreed to proceed with the rehabilitation works after a minimum number of 220 purchasers execute the said agreement. The execution of the said agreement between the company and the purchasers which began last Wednesday has todate seen 127 purchasers execute the said agreement.

It is hoped that the remaining purchasers will come forward and execute the said agreement. Towards this end they can do so by coming to the 53rd floor of KOMTAR this coming Wednesday, 17 December 2014 from 2pm until 4pm or make an appointment with the solicitors Salina, Lim Kim Chuan & Co.

The Penang state government views seriously the plight of those purchasers which have become victims of abandoned housing projects and will facilitate to the best of its ability the rehabilitation of such projects in the interests of the said victimised purchasers.

槟州政府成功振兴共有370名购屋者的大华高原2A计划,撮成国云集团有限公司振兴这项自1998起即被搁置的房屋发展计划。

国云集团在今年4月份作出宣布后,这家白武士公司目前正敲定将由购屋者及其旗下子公司PLB KH Bina 有限公司的建筑合约。

合约条款当中,包括购屋者只需缴付1万令吉总额给同时代表双方的律师楼,即首批5千令吉在工程启动时,将发放给有关的发展商,余额的5千令吉则将会在有关计划完工后发放。原本国云集团向州政府建议,每一名购屋者需缴交4万5千令吉以复兴大华高原2A房屋发展计划。不过,经过州政府与发展商的谈判后,发展商同意只向每名购屋者征收1万令吉。振兴大华高原2A房屋发展计划,总开销为1千700万令吉。

在州政府的谈判下,发展商也同意将有关计划的缺陷责任期,从原有的3个月延长至 12个月。

在有关的建筑合约下,国云集团同意在收集至少220名购屋者履行协议后,就会执行是项振兴大华高原2A房屋计划的协议。有关公司与购屋者的协议,从上周三起迄今,共获得127名购屋者履行协议。

我们希望剩余的购屋者,能够挺身履行协议。他们可以在本周三(12月17日)下午2时至4时之间到光大53楼与相关的律师安排日期。

槟州政府严正看待被搁置房屋发展计划的事件,并将会竭尽所能,重振这些被搁置的计划,以为被牺牲的购屋者讨回一个公道。

The police report lodged by Batu Kawan Umno vice-chief Khairuddin Abu Hassan against 1Malaysia Development Bhd (1MDB) for mismanagement of funds has exposed the intense internal power struggle and crisis within UMNO. UMNO cannot distract attention from the UMNO internal crisis over 1MDB by bullying me with lies that I am trying to interfere in Islamic affairs for my statement that an Islamic religious edict or fatwa is not applicable on non-Muslims because Islamic laws cannot be imposed on non-Muslims.

This position that a fatwa does not apply to non-Muslims is not only human and morally right but also sanctioned by the Federal Constitution and even embodied by the Administration of the Religion of Islam(State of Penang) Enactment 2004. Section 49(1) of the Enactment states that a fatwa shall be binding on every Muslim in the state…, without mentioning non-Muslims, clearly restricting its application on Muslims.

I regret that Home Minister Datuik Seri Ahmad Zahid Hamidi has either been misinformed or is deliberately trying to distort the issue for political gain to raise hatred and threaten me for interfering in Islamic affairs when I have not done so. Instead Ahmad Zahid should be training his guns on MCA for demanding that the Penang state government repeal the Administration of the Religion of Islam(State of Penang) Enactment 2004 to allow the use of Allah by Christians.

Neither DAP nor the Penang state government had ever asked for the repeal of the Administration of the Religion of Islam(State of Penang) Enactment 2004. This inflammatory demand by MCA calling for the repeal of the Islamic Enactment is clearly a definite and serious interference in the administration of Islamic affairs? Why then is there no action or attacks by UMNO on MCA? Clearly UMNO and MCA are playing a double-faced political game of attacking me for being anti-Islam whilst both Gerakan and MCA has even attacked me for being anti non-Muslim for doubling the annual budget’s allocation for Islamic affairs, as compared to the previous BN government.

Non-Muslims and moderate Muslims generally disagree with the BN Federal government’s decision to ban Christians, especially form Sabah and Sarawak who had been praying in Bahasa Malaysia, from using the word Allah. However despite this disagreement, the Penang state government respects the decision made by the Federal Court that the Catholic publication “The Herald”, is forbidden from using the word Allah.

Even though the Penang state government may not agree with the court’s decision, as a government that is run on the basis of respect for the rule of law, the Penang state government will abide by the court decision. This was displayed by our acceptance of the Federal Court’s decision to reject our application to conduct local government elections and return the third vote.

I had responded to MCA’s lies, that the present Administration of the Religion of Islam(State of Penang) Enactment 2004 and the fatwas issued under the Enactment only covers Muslim and is not enforceable on non-Muslims as Islamic laws are not applicable on non-Muslims. Accordingly, any fatwa issued(including those banning the use of certain words) does not apply to non-Muslims and Penang cannot forbid any non-Muslim from using certain words. This legal position has been confirmed by prominent lawyers such as the late Karpal Singh.

I am stating the legal position that the Penang state religious bodies have authority over Muslims, but not non-Muslims. Of course Ahmad Zahid or other UMNO leaders can choose to extend Federal government powers of Islamic laws on non-Muslims if they desire to do so, but their disputed legality can then be challenged and decided in courts. Ahmad Zahid should not try to twist the issue to one of the Penang Chief Minister’s interference of Islamic affairs when it is about stating that the there is no legal authority to apply fatwas on non-Muslims in Penang.

峇都加湾巫统副主席凯鲁丁阿布哈山针对一马发展机构的资金管理不当报警,揭露了巫统内部内部激烈的权力斗争及内部危机。巫统不能利用谎言欺负我来转移视线掩盖巫统本身在一马发展机构的内部危机,他们谎说我企图干预伊斯兰事务,我早前声明伊斯兰法规(FATWA)不适用于非穆斯林身上,因为伊斯兰法不能实施于非穆斯林身上。
伊斯兰法规不适用于非穆斯林,这是符合人性及道德权利,联邦宪法及2004年伊斯兰行政法(槟州)也如此阐明。伊斯兰行政法第49(1)条文阐明,伊斯兰法规约束州内所有穆斯林…,并没有提及非穆斯林,很明显地,它只适用于穆斯林身上。

我对于内政部长拿督斯里阿末查希的言论感到遗憾,他可能被错误通知或者为了政治利益故意扭曲这个课题,以引发仇恨及威胁我干预伊斯兰事务,而我根本没有这么做。反之,阿末查希应该要把枪口对向马华,因为马华要求槟州政府修改2004年伊斯兰行政法(槟州),好让基督徒也能使用“阿拉(Allah)”字眼。

行动党或槟州政府从来没有要求修改2004年伊斯兰行政法(槟州)。马华煽动地要求修改伊斯兰条例很明显地是要干预伊斯兰行政事务,为什么巫统不攻击马华,很明显地,巫统和马华在玩弄双面人政治游戏,一方面攻击我反穆斯林,一方面民政党和马华却攻击我反非穆斯林,他们质疑州政府在伊斯兰事务方面的拨款比国阵政府增加两倍。

非穆斯林及中庸穆斯林普遍上不赞同国阵联邦政府禁止基督徒特别是沙巴及砂拉越州在用马来文祷告时使用“阿拉”(Allah)一词。但是,尽管如此,槟州政府尊重联邦法院的裁决,那就是天主教《先驱报》被禁使用“阿拉”一词。

虽然槟州政府不一定同意法庭的判决,做为一个尊崇法治的政府,槟州政府会遵守法庭的决定。从我们接受联邦法院拒绝我们举行地方政府选举、还民第三票的裁决可以知道。

我已经回应马华的谎言,现有的2004年伊斯兰行政法(槟州)及其相关伊斯兰法规只适用于穆斯林,而不能强制于非穆斯林,因为伊斯兰法不适用于非穆斯林。以此类推,任何伊斯兰法规(包括禁止使用特定用词)不能实施于非穆斯林,而槟城也不能禁止任何非穆斯林使用这些用词。数名著名的律师包括已故卡巴星已经肯定这项法律立场。

我要确定的司法立场就是,槟州宗教团体能对穆斯林采用权力,而不是非穆斯林。当然,阿末查希或其它巫统领袖可以选择延伸联邦政府的权力,让伊斯兰法加诸于非穆斯林身上, 但是他们具争议的合法问题可以被挑战及被法庭裁决。阿末查希不应该扭曲课题,诬指槟州首长干预伊斯兰事务,而事实上在槟城根本没有司法机构可以将伊斯兰法规实施于非穆斯林身上。

State Christmas Open House @ 14th December 2014 at Fort Cornwallis

WELCOME.

On behalf of the Penang State Government, we would like to warmly welcome everyone of you to our Penang State Christmas Open House 2014. This event is being jointly organised by the Penang State Government and Christian Federation of Malaysia (CFM) Penang. I wish everyone here a very Blessed and Joyous Christmas.
The theme for the Christmas Open House this year is

Jesus – Prince of Peace

In a world, torn by selfishness and strife, and in a country that is often confronted by racial disharmony and religious bigotry, the message of PEACE, SALAM, 平安, SAMATHANAM, must ring out loud and clear to all our citizens, at this time of Christmas and also throughout the year.

As we read the news on the papers or watch the news on TV, we know only too well that the world is badly in need of peace between neighbours, and between countries. Hence, we must all work together and do everything we can to bring peace to everyone around us.

The message of Christmas is that God sent His Son Jesus Christ into the world to bring to the peoples:
“Peace on earth, and good will toward all people.”

People fight and countries go to war because they do not know peace. We can only have peace when we have found peace for ourselves, and then we share this peace with everyone around us. And this is the peace that Jesus Christ came to give to all those who will open their hearts and their lives to Him, the Prince of Peace. We can have peace with God, we can have peace with ourselves, and we can have peace with our neighbours. If everybody knows this peace, then there will be peace all around, --our neighbourhoods, our kampongs and towns, our country and the whole world will know greater love, joy and peace. When we work together for the welfare of everyone around us , and share our wealth and resources with those in need, there will be greater thanksgiving and mutual love, respect and appreciation, and everyone will be happier.

The Christians in Malaysia have always worked for greater peace and harmony among the peoples to promote the welfare and development of our country. In the past we have built schools and hospitals that are open to boys and girls, men and women, without any discrimination of race , or colour, or religion, for the benefit of everyone. Today, we still run many social services like orphanages, old folks’ home, drug re-hab centres, schools for the disadvantaged and refugees who have nowhere else to go to.

Christians and churches do this because they know they have the Prince of Peace in their hearts and in their lives, and they will keep working for greater peace for our country, and bring love and joy to as many people as we can. This Christmas Open House is one way for the Christians to share the joy and peace they have with our fellow-citizens in Penang and Malaysia and our friends visiting our beautiful country from overseas. We have again raised funds from among our churches for a special Christmas gift to three charities in Penang that are working among the poor and needy to help them in their work. This is the true message of Christmas. May God bless you with His peace this Christmas and throughout the New Year.

I would also like to share with you the meaning of Christmas - which is "sacrifice". Sacrifice is seem as negative because we, have to incur losses. However if we see Jesus' sacrifice, his loss is our gain. And Jesus gained too from his sacrifice - he gained by saving the souls from Satan.

Let us see sacrifice not in terms of immediate loss but place our trust that we will benefit when all benefits from our sacrifice.

We would like to thank the organizing committee, pastors, leaders and members of various churches as well as YB Wong Hon Wai and his staff, and other representatives from the Penang State Government and all those who have worked tirelessly to make this event a success.

The Royal Commission to Enhance the Operations and Management of the Royal Malaysian Police published its report in May 2005 – 9 years ago - to address challenging issues facing the Police force, among which were the “widespread concerns regarding the high incidence of crime, perception of corruption in the Royal Malaysia Police, general dissatisfaction with the conduct and performance of police personnel and a desire to see improvements in the service provided by the police”.

In addition, the Royal Commission also identified that there were too many deaths in custody, the failure of the police to investigate them and the failure to hold inquests into these deaths. These were key concerns raised by members of the public, non-governmental organizations and international organisations.
The Royal Commission recommended the establishment of an Independent external oversight entity known as the Independent Police Complaints and Misconduct Commission (IPCMC) and who shall perform the following functions
• Receive and investigate complaints about PDRM and its personnel
• Prevent, detect and investigate corruption
• Prevent, detect serious misconduct in PDRM
• Propose measures to the Minister of Internal Security namely
o Improve police integrity
o Reduce misconduct
 “misconduct” includes police corruption, commission of criminal offence and non-compliance with legal and police regulations
o Build public confidence in PDRM

The status of IPCMC would be as an independent body established pursuant to an Act of Parliament, whereby the Royal Commission had also drafted the proposed bill.
The proposed IPCMC would consist of the following:
- 7 commissioners
- With a tenure that is limited to three years
- Members not from retired or serving police force
An Annual Report would be presented to the Parliament for updates, statistics and details of the matters looked into.
However, regrettably to date, the IPCMC has not been introduced despite the continued occurrence of deaths in custody, the high incidences of crime, the perception of corruption and the general dissatisfaction due to the conduct and performance of the police personnel. The recommendation made by the Royal Commission on the IPCMC has not accepted by the Government. Instead, Parliament passed the EAIC (Enforcement Agency Integrity Commission) which is a gross failure.

Years after Kugan's death under police custody in 2009, nothing has changed, even though the IGP Khalid Abu Bakar was liable to misfeasance according to the High Court. This failure to set up ICPMC costs human lives as shown by at least 13 in custodial deaths under police detention this year, of which 7 are in Penang. DAP believes that police custodial deaths can be reduced if there is an IPCMC.

Human Rights Watch (HRW) in its 'No Answers, No Apology: Police Abuses and Accountability' report released in April this year in Kuala Lumpur revealed that just 7 percent of complaints against the police force between 2005 and 2012 reached a courtroom while more than half the cases has yet to be fully investigated.

From extrajudicial killings of teenagers to custodial deaths, threats to lawyers and assaults on journalists covering demonstrations, the report gives chilling and bloody first-person accounts of police abuse and misconduct. The report without a shadow of doubt further showed the urgency of setting up an external oversight body like IPCMC. But the government is still adamant in refusing to set up the IPCMC when such oversight body has been set up in many other countries.

The inspector-general of police (IGP) Khalid Abu Bakar said that the police were not in favour of the setting up of IPCMC last year because the terms in the proposal treated police like second-class citizens. He claimed that a policeman picked up for corruption does not have the right to defend himself in the IPCMC.

Let the lawyers here deal with the police's concerns that they will be denied justice so that we can set up the IPCMC to both defend the public from abuses by the very force that are supposed to protect them as well as uphold the basic concept that the police can be held to account under the law and that no one should be given the privilege to investigate or judge their own alleged wrongdoings.

The IPCMC can also help to prevent the police from being abused and misused for political reasons such as these actions taken against PPS our Voluntary Patrol Unit and double-standards in investigating Sedition Act against opposition leaders and dissidents whilst UMNO leaders who preach religious and racial hatred escape unpunished.

Witness the inaction against UMNO ex-Deputy Minister Datuk Dr Mashitah Ibrahim's dangerous lies accusing the Chinese community for burning the Quran through the Chinese's religious rituals, even though Kedah Menteri Besar Datuk Mukhriz Mahathir had earlier announced, it was done by a mentally demented Malay Muslim, who had since been arrested and sent for medical treatment. Or Permatang Pauh UMNO Division Chief Datuk Mohd Zaidi Mohd Said's false claims that the Chinese economic strength was also due some of the time to the illegal activities of prostitution, gambling and entertainment outlets when even the Penang police had denied that there were any illegal activities.

I applaud the Bar Council and Penang Bar Committee for stepping up and taking the initiative to educate members of the public and society at large on the need for police accountability as there is not much publicity or understanding on why an independent body is needed to ensure a check and balance is in place for the law enforcement in this country.
